These Terms & Conditions ("Terms") govern your use of the website at stormriverhomes.com (the "Site"), your communications with us, and your participation in our text message marketing program (the "Messaging Service"), all operated by StormRiver Real Estate LLC, doing business as StormRiver Homes ("we," "us," or "our"). By using the Site or the Messaging Service, you agree to these Terms.

1. About Us

StormRiver Homes is a brand owned and operated by StormRiver Real Estate LLC, a real estate investment company located at 730 Peachtree Street NE, Suite 570, Atlanta, GA 30308. We purchase residential properties in Atlanta, Georgia, and surrounding areas.

2. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any way that violates applicable law, infringes the rights of others, or interferes with the operation of the Site.

3. No Real Estate, Legal, Tax, or Financial Advice

Information on the Site is provided for general informational purposes only and does not constitute real estate, legal, tax, or financial advice. Any cash offer we provide is non-binding until a written purchase agreement is signed by both parties. You should consult your own professional advisors before making any decision relating to the sale of real property.

4. Cash Offer Requests

By submitting a cash offer request form, you authorize StormRiver Real Estate LLC and its authorized representatives to contact you by phone, email, or text message about your property and our potential purchase, regardless of any prior listing on the National Do Not Call Registry, until you ask us to stop. You represent that the information you provide is accurate to the best of your knowledge and that you have the authority to receive offers on the property identified.

5. SMS / Text Messaging Terms

You agree to receive recurring automated promotional and personalized marketing text messages (e.g., SMS and MMS—including cash offer follow-ups, appointment reminders, and property updates) from StormRiver Homes, a brand owned and operated by StormRiver Real Estate LLC, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate. Consent to receive automated marketing text messages is not a condition of any purchase or sale of property. Msg & Data rates may apply. Message frequency will vary. StormRiver Real Estate LLC reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. StormRiver Real Estate LLC also reserves the right to change the short code or phone number from which messages are sent and we will notify you when we do so. Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. StormRiver Real Estate LLC, its service providers (including Launch Control and Textedly), and the mobile carriers supported by the program are not liable for delayed or undelivered messages.

We are able to deliver messages to the following mobile phone carriers: AT&T, Verizon Wireless, T-Mobile, US Cellular, and other major national and regional carriers.

Cancellation. Text the keywords STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to cancel. After texting STOP, END, CANCEL, UNSUBSCRIBE, or QUIT you will receive one additional message confirming that your request has been processed. You acknowledge that our text message platforms (Launch Control and Textedly) may not recognize and respond to unsubscribe requests that do not include the STOP, END, CANCEL, UNSUBSCRIBE, or QUIT keyword commands and agree that Launch Control, Textedly, and their service providers will have no liability for failing to honor such requests.

6. Intellectual Property

The Site may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of those third parties.

8. Disclaimers

The Site, the Messaging Service, and any information or offer provided are made available on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, or accuracy. We do not guarantee that the Site will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, StormRiver Real Estate LLC, its affiliates, officers, employees, agents, and service providers (including Launch Control and Textedly) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or the Messaging Service.

10. Indemnification

You agree to indemnify and hold harmless StormRiver Real Estate LLC, its affiliates, officers, employees, agents, and service providers from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of your violation of these Terms or your misuse of the Site or Messaging Service.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or your use of the Site or Messaging Service will be resolved in the state or federal courts located in Fulton County, Georgia, and you consent to the personal jurisdiction of those courts.

12. Privacy

Your use of the Site and Messaging Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. In the event of a conflict between these Terms and our Privacy Policy regarding the Messaging Service, these Terms control.

13. Changes to These Terms

We may modify these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Your continued use of the Site or Messaging Service after a change constitutes acceptance of the modified Terms.
